These Terms of Service ("Terms") govern your use of the ShakeSphere Australia website (shakesphere.com.au) and your purchase of products from us. By accessing our website or placing an order, you agree to these Terms.

By using our website or purchasing from us, you confirm that you are at least 18 years of age (or have the consent of a parent or guardian) and that the information you provide is accurate and complete.
We reserve the right to refuse service, cancel orders, or close accounts at our discretion.
2. Products and Pricing
All prices are displayed in Australian Dollars (AUD) and include GST unless otherwise stated.
We make every effort to ensure product descriptions and images are accurate. However, we do not warrant that descriptions are error-free, complete, or current. If a product you receive is materially different from its description, please contact us at australia@shakesphere.com.
We reserve the right to modify prices at any time. Price changes will not affect orders already confirmed.
In the event of a pricing error, we reserve the right to cancel the order and issue a full refund. We will notify you promptly if this occurs.
3. Orders and Payment
By placing an order, you make an offer to purchase the product(s) at the listed price. We reserve the right to accept or decline any order.
Order confirmation emails do not constitute acceptance — acceptance occurs when your order is dispatched.
We accept payment via Visa, Mastercard, American Express, PayPal, Shop Pay, and Afterpay. All payments are processed securely. We do not store your full card details.
4. Shipping and Delivery
Please refer to our Shipping Policy for full details on delivery timeframes, costs, and destinations.
Risk of loss and title for products passes to you upon delivery to the shipping carrier.
5. Returns and Refunds
Please refer to our Refund & Returns Policy for full details. Nothing in these Terms affects your rights under the Australian Consumer Law.
6. Warranty
ShakeSphere products are covered by a 12-month warranty against manufacturing defects from the date of purchase. This warranty does not cover:
- Normal wear and tear
- Damage caused by misuse, accidents, or failure to follow care instructions
- Damage caused by use contrary to the product's intended purpose
- Products that have been modified or repaired by unauthorised parties
To make a warranty claim, contact us at australia@shakesphere.com with your order number and details of the defect.
This warranty is in addition to, and does not limit, your rights under the Australian Consumer Law.
7. Intellectual Property
All content on this website — including text, images, graphics, logos, and product descriptions — is the property of Stuff Distribution Pty Ltd or its licensors and is protected by Australian and international copyright laws.
The ShakeSphere capsule-shaped shaker design is patented. You may not reproduce, distribute, or use our intellectual property without our prior written consent.
8. Limitation of Liability
To the extent permitted by law, ShakeSphere Australia's liability for any claim arising from your use of our website or purchase of our products is limited to the amount you paid for the relevant product.
We are not liable for indirect, incidental, special, or consequential damages. Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law.
9. Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of our website after changes are posted constitutes acceptance of the revised Terms.
